Vereinbarung Buchungsprovision über externe Verkaufskanäle

Abgeschlossen zwischen der SalzburgerLand Tourismus GmbH 5300 Hallwang bzw. dem jeweils örtlich/regional zuständigen Feratel-Deskline Datenhalter (Tourismusverband) und dem jeweiligen Betrieb zu diesem WebClient Benutzer.

Zusätzlich zur bereits bestehenden Buchbarkeit über die Webseite des Ortes und der Region möchte der Betrieb seine Zimmer/Appartements auch über externe Verkaufskanäle gegen entsprechende Provisionszahlungen buchbar machen. Die jeweilige Provision beträgt standardmäßig 10%, kann aber von Portal zu Portal variieren. Die aktuelle Höhe ist im WebClient beim jeweiligen Portal ausgewiesen. Bei einer Änderung der Provisionssätze erfolgt eine Information im Nachrichten-System des WebClients (bzw. per E-Mail an die hinterlegte E-Mail-Adresse des Betriebes).

Der Vermieter verpflichtet sich bei Buchungen über externe Verkaufskanäle die Provisionsgebühr zuzüglich Umsatzsteuer zu bezahlen. Die Fälligkeit der Provision erfolgt per Abreisedatum und wird vom jeweiligen Datenhalter (Tourismusverband) vorgeschrieben. Die Abrechnung erfolgt in regelmäßigen Abständen mit Rechnungslegung per Post oder per E-Mail.

Im Übrigen gelten die Bedingungen des Kooperationsvertrags zwischen dem Betrieb und dem jeweiligen Datenhalter (Tourismusverband) über die Datenwartung. Insbesondere gilt die Verpflichtung zur regelmäßigen, korrekten und gewissenhaften Wartung der Kontingente, zur korrekten Eingabe von Preisen, An- und Abreisebedingungen, Storno- und Zahlungsbedingungen sowie zur richtigen Wartung der Verkaufseinstellungen (Online-Buchbarkeit).

Buchungen, die online über einen Verkaufskanal des Datenhalters (Tourismusverbandes) getätigt werden, gelten als verbindlich!

ACHTUNG: Mögliche Preiserhöhung bei HRS Destination Solutions (HI)!
Grundsätzlich werden bei Buchungen über HRS die üblichen 10 % Provision (netto) vom Gesamtpreis verrechnet. Da bei ein paar angeschlossenen Plattformen von HRS der Provisionssatz aber höher ist, hat HRS jetzt die Möglichkeit den im Feratel WebClient eingetragenen Preis nach oben anzupassen.

D.h. in diesen speziellen Fällen wird ein „Provisionsausgleich“ vorgenommen. Der Betrieb muss dann vom Gast den höheren Preis (entsprechend der Buchungsinformation von HRS) kassieren. Letztendlich fällt zwar mehr Provision an, dem Betrieb bleibt aber der gleiche Erlös als sonst.

Ein Beispiel dazu:
A) Normale HRS Buchung mit 10% Provision:
     Der Betrieb verrechnet dem Gast € 100,-
     und bezahlt € 12,- Provision (= € 10,- + € 2,- USt).

B) Buchung mit Provisionsausgleich:
     HRS erhöht den Preis z.B. auf € 110,- und informiert den Betrieb darüber.
     Der Betrieb verrechnet dem Gast € 110,- und bezahlt € 22,- Provision.

→ In beiden Fällen bleibt dem Betrieb der selbe Endpreis (abzgl. Provision),
     im Beispiel oben wären es € 88,- im Fall A sowie im Fall B.

Guest Registration Data

 

As a guest, you are required by the Austrian Registration Act to register the specified data with us in accordance with § 5 and § 10 of the Registration Act.

This concerns the following data: name, date of birth, gender, nationality, country of origin, address including postal code, arrival and departure date; for guests from abroad, a description of the travel document (type, number, date of issue, issuing authority) is required.

We will keep this data in a guest directory based on the legal obligation imposed on us in accordance with § 19 of the Reporting Act Implementation Ordinance and store it for a period of 7 (seven) years, as long as the data is not needed for a longer processing period for purposes other than referred to in this data privacy policy (e.g., you may have given your consent to receive marketing materials).

 

The data for arrival and departure in connection with the country of origin is forwarded to the municipality in which our accommodation facility is located in accordance with § 6 of the Tourism Statistics Ordinance. The respective tourism association (TVB) to which we belong and/or the municipality also has aggregated data forwarded to them based on the number of overnight stays and persons obliged to pay the local tourism tax. This takes place in accordance with the local Tourism Tax Act.

The related processing steps are based on Art. 6 par. 1 lit. c GDPR.

 

In addition, we forward the postal code (in pseudonymized or anonymized form) you have provided to the respective tourism association (TVB) and/or the respective municipality for statistical purposes for the TVB to prepare and evaluate the statistics of origin. This forwarding is based on Art. 6 par. 1 f GDPR. You can object to this at any time to your tourist accommodation facility.

 

For electronic guest directories:

We manage the guest directory electronically, whereby we forward the related data to a processor. The data is stored with this processor. Transfer of data to a third country will never take place.
